Workers’ Compensation FAQ’S

Question: Do I need a lawyer on my Workers’ Compensation case?
Answer: While you do not need a lawyer on a Workers’ Compensation case it is strongly recommended as generally speaking you are much more likely to have a favorable result on your case should you have legal representation in your corner. In our opinion insurance companies do not treat unrepresented individuals the same way they treat individuals represented by an attorney and generally speaking settlements of an unrepresented individual are much lower than settlements of those represented by counsel.

Question: Will I be fired by my employer if I file a Workers’ Compensation claim?
Answer: It is illegal for your employer to take an adverse employment reaction against you solely for filing a Workers’ Compensation claim.

Question: When should I report a work related accident to my employer?
Answer: It is important that you report all work related accidents to your employer immediately upon your knowledge of a work related injury. Often, insurance companies will use failure to report in a timely manner as a defense in Workers’ Compensation proceedings

Question: How are attorney fees calculated in Workers’ Compensation cases?
Answer: Attorney fees are set by the state in Workers’ Compensation cases and are generally much less than the standard one third contingency fee which is found on most personal injury cases.

Question: I do not have health insurance, how do get my medical bills paid?
Answer: Workers’ Compensation is a system designed to provide for medical coverage for work related injuries. As long as your treatment is reasonable and related to your original Workers’ Compensation injury, the Workers’ Compensation insurer is obligated to pay such medical bills on your behalf. In the event that the insurance company fails to pay the bills in a timely manner, you will always have a right to file a claim with your local Workers’ Compensation board in order to properly protect your interests
